Hypothetical Example of Unpaid Wage Claim

Suppose a $20.00 per hour distributor worked 15 hours of overtime per week over a three year period but was not paid for such time at one and-one half times the regular hourly rate of pay. Suppose further a court found willful violations and applied liquidated  (double) damages for the wage violations under the Fair Labor Standards Act.

Such unpaid wage claim could be calculated as follows:

$20.00 x 15 hours per week x 150 (weeks) x 1.5 (overtime rate) x 2 (liquidated damages)  = 

$135,000.00

DISCLAIMER: The above example is merely a hypothetical of how unpaid overtime could be calculated if such a factual situation was presented to a Court or arbitrator and does not represent any adjudicated claim, considering there are numerous factual. legal and procedural issues that arise in any type of litigation that could present a different result.
